Bylaw 10.3 and Related Cases
Bylaw 10.3
Bylaw 10.3 states the following:
Staff members of a member conference, staff members of the athletics department of a member institution and student-athletes shall not knowingly:
- Provide information to individuals involved in organized gambling activities concerning intercollegiate athletics competition;
- Solicit a bet on any intercollegiate team;
- Accept a bet on any team representing the institution;
- Solicit or accept a bet on any intercollegiate competition for any item (e.g., cash, shirt, dinner) that has tangible value; or
- Participate in any gambling activity that involves intercollegiate athletics or professional athletics, through a bookmaker, a parlay card or any other method employed by organized gambling
The following sanctions for violations of Bylaw 10.3 apply:
- A student-athlete who engages in activities designed to influence the outcome of an intercollegiate contest or in an effort to affect win-loss margins (i.e., "point shaving") or who solicits or accepts a bet or participates in any gambling activity through a bookmaker, a parley card or any other method employed by organized gambling that involves wagering on the student-athlete?s institution shall permanently lose all remaining regular-season and postseason eligibility in all sports.
- A student-athlete who solicits or accepts a bet or participates in any gambling activity that involves intercollegiate athletics or professional athletics, through a bookmaker, a parlay card or any other method employed by organized gambling, shall be ineligible for all regular-season and postseason competition for a minimum of a period of one year from the date of the institution's determination that a violation has occurred and shall be charged with the loss of a minimum of one season of competition. If the student-athlete is determined to have been involved in a subsequent violation of any portion of Bylaw 10.3, the student-athlete shall permanently lose all remaining regular-season and postseason eligibility in all sports. Five student-athletes participated in gambling football pool, each wagering over $300. Student-athletes did not know that it was impermissible to wager on professional football. Institution made student-athletes sit out a year due to lengthy investigation. Student-athletes were also required to do 10 hours of community service and repay to charity the amount wagered.
Eligibility ID-26367; Secondary ID-25195:
Student-athlete wagered $10 on Super Bowl. Institution made student-athlete donate $10 to charity, sit out first contest and one week of practice. Eligibility reinstated based on institutions actions.
Eligibility ID-24638; Secondary ID-23388:
Student-athlete entered a $20 football bowl contest pool with the winner receiving $1200. Institution made student-athlete complete 10 hours of community service. Eligibility reinstated after student-athlete sat out 10 percent of regularly scheduled contests of the season. Reasons for 10 percent rule: pool had large number of people; amount of winnings was $1200; pool involved college teams; and student-athlete had received gambling education.
Eligibility ID-24291; Secondary ID-22795:
Student-athlete wagered a maximum of $10 with friends on a professional football game. Institution suspended student-athlete from one regular season game and made student-athlete complete 10 hours of community service. Eligibility reinstated on the condition that student-athlete complete the community service.
Eligibility ID-23242; Secondary ID-21612:
Football student-athlete used Internet gambling site to wager $365 on college and pro basketball games. Student-athlete thought the only sport he was not allowed to bet on was football. Institution declared student-athlete ineligible. Student-athlete reinstated after sitting out a year of regular and postseason competition.
Eligibility ID-22633; Secondary ID-20318:
Student-athlete made "friendly wager" with a radio host on the outcome of his own game. Bet that if the team won, the radio host would have the student-athlete over for dinner, and if the team lost, the student-athlete would wear the opposing team's jersey on campus. Institution required student-athlete to complete 10 hours of community service. Eligibility reinstated.
Eligibility ID-19095; Secondary ID-14521:
Student-athlete placed five bets on college and professional football through Internet gambling site. Institution referred student-athlete to university counseling center. Student-athlete had to sit out for a year of competition.
Eligibility ID-16931:
Student-athletes paid $5 for NCAA Final Four pool. Student-athletes did not know participating in the pool would jeopardize eligibility. Student-athletes did not win any money. Student-athletes' eligibility reinstated.
Eligibility ID-15295:
Student-athlete placed five $100 bets on professional basketball games. Institution made student-athlete perform 30 hours of community service and suspended him from residence halls for two weeks. Student-athlete had to sit out first contest of the season.
Eligibility ID-15187; Secondary ID-9717:
Coach wagered $10 on soccer game that coach was involved in. Coach suspended one month without pay. Coach was suspended for two contests, was placed on one year probation and received a two-year salary freeze. The coach was also not permitted to recruit off-campus for one year.
Secondary ID-12041:
Compliance coordinator wagered on hockey and football games using Internet gambling site. Coordinator resigned position.
Secondary ID-22615:
Student-athlete participated in $5 NCAA basketball pool. Student-athlete did not win any money or other items. Student-athlete had exhausted eligibility when violation occurred. Institution will have a rules seminar to specifically deal with gambling issues.
Secondary ID-24967:
Sports information director/compliance coordinator bet $25 in Las Vegas on a parlay card that included Major League Baseball, Canadian Football League and Women's National Basketball Association games. Institution sent him a letter of admonition and made a $50 donation to charity.
Secondary ID-12199:
Former student-athlete was involved in sports wagering activities. Athletics aid was withdrawn.
Secondary ID-21904:
Coaches and members of the athletics department staff participated in a fantasy football league. Each entrant paid $20-$35 for a potential prize of $200. The most that any of them won was $60. Each person had to withdraw from league, and letters of reprimand were placed in each person's permanent file. Any prize money received had to be donated to charity.
Secondary ID-22031:
Head coach and assistant coach participated in fantasy football league with an entry fee of $50. Coaches withdrew from league prior to paying the entry fee. Institution reprimanded the coaches.
Secondary ID-22630:
Director of athletics paid $5 for NCAA basketball bracket with people in his neighborhood. Director of athletics won $25. Letter of corrective action placed in director of athletics' file, and he donated $25 to charity. Institution will continue to educate staff on the importance of abiding by NCAA regulations.
Secondary ID-10964:
Assistant coach placed bets totaling $300 on professional football and baseball games. Institution suspended coach pending investigation.
Eligibility ID-18444:
Student-athlete placed six bets totaling $150 on professional basketball. Student-athlete made to sit out 50 percent of season.
Eligibility ID-26655; Secondary ID-25339:
Seven student-athletes placed bets through a campus bookie, and two had debts of $1500. All student-athletes acknowledged signing NCAA statement prohibiting gambling. Institution suspended all seven student-athletes pending an investigation.
Eligibility ID-15132:
Student-athletes placed bets on parlay cards, distributed parlay cards to others and returned the cards and wagers to a bookmaker. Student-athletes accepted wagers by keeping parlay cards and covering wagers themselves. Eligibility reinstated after student-athletes sat out 50 percent of season.
