NCAA Rules Pertaining to Transfers
13.1.1.3 Four-Year College Prospective Student-Athletes.
An athletics staff member or other representative of the institution's athletics interests shall not make contact with the student-athlete of another NCAA or NAIA four-year collegiate institution, directly or indirectly, without first obtaining the written permission of the first institution's athletics director (or an athletics administrator designated by the athletics director) to do so, regardless of who makes the initial contact. If permission is not granted, the second institution shall not encourage the transfer and the institution shall not provide athletically related financial assistance to the student-athlete until the student-athlete has attended the second institution for one academic year. If permission is granted to contact the student-athlete, all applicable NCAA recruiting rules apply.
13.1.1.3.1 Hearing Opportunity.
If the institution decides to deny a student-athlete's request to permit any other institution to contact the student-athlete about transferring, the institution shall inform the student-athlete in writing that he or she, upon request, shall be provided a hearing conducted by an institutional entity or committee outside of the athletics department (e.g., the office of student affairs; office of the dean of students; or a committee composed of the faculty athletics representative, student-athletes and nonathletics faculty/staff members). The institution shall have established reasonable procedures for promptly hearing such a request.
13.1.1.3.2 Student-Athlete Withdrawn from Four-Year College.
A member institution may contact a student-athlete who has withdrawn officially from a four-year collegiate institution without obtaining permission from the first institution only if at least one academic year has elapsed since the withdrawal.
14.5.5.2.10 One-Time Transfer Exception.
The student transfers to the certifying institution from another four-year collegiate institution, and all of the following conditions are met (for graduate students, see also Bylaw 14.1.9.1):
- The student is a participant in a sport other than basketball, bowl subdivision football or men's ice hockey at the institution to which the student is transferring. A participant in championship subdivision football at the institution to which the student is transferring may use this exception only if the participant transferred to the certifying institution from an institution that sponsors bowl subdivision football and has two or more seasons of competition remaining in football or the participant transfers from a football championship subdivision institution that offers athletically related financial aid in football to a football championship subdivision institution that does not offer athletically related financial aid in football;
- The student has not transferred previously from one four-year institution unless, in the previous transfer, the student-athlete received an exception per Bylaw 14.5.5.2.6 (discontinued/nonsponsored sport exception);
- The student is in good academic standing and meets the progress toward degree requirements. The transferring student must be one who would have been academically eligible had he or she remained at the institution from which the student transferred, and he or she also must be eligible at the certifying institution as a regularly enrolled, full-time, degree-seeking student who was admitted in accordance with the regular, published entrance requirements of the institution. The student shall not be required to fulfill the necessary percentage-of-degree requirements at the previous institution; and
- If the student is transferring from a NCAA or NAIA member institution, the student's previous institution shall certify in writing that it has no objection to the student's being granted an exception to the transfer-residence requirement. If the student's previous institution denies his or her request for the release, the institution shall inform the student-athlete in writing that he or she, upon request, shall be provided a hearing conducted by an institutional entity or committee outside of the athletics department (e.g., the office of student affairs; office of the dean of students; or a committee composed of the faculty athletics representative, student-athletes and nonathletics faculty/staff members). The institution shall have established reasonable procedures for promptly hearing such a request.
In addition to NCAA rules governing transfers, the Big 12 Conference has established a rule applying to intraconference transfers.
Big 12 Conference Rule 6.5
The eligibility of a student-athlete who transfers directly or indirectly from one conference member institution to another shall be determined by NCAA regulations. In the event NCAA regulations require the student to complete on full academic year in residence before being eligible to compete in a sport, the student-athlete shall also forfeit one season of competition in that sport.
A 4-2-4 transfer student-athlete who is in compliance with NCAA Bylaw 14.5.6 [4-2-4 College Transfers] must complete one full academic year in residence before being eligible to compete in a sport and forfeit one season of competition unless, in sports other than football and basketball, the director athletics of the conference member institution of initial enrollment consents in writing to the student-athlete's enrollment at the second conference member institution. Any consent given relating to a direct or indirect intraconference transfer may be unconditional or conditioned on the student-athlete's completing one full academic year in residence at the second conference member institution before competing.
Appeals Process
Under NCAA Bylaw 13.1.1.3.1, should Oklahoma State deny a student-athlete's request to permit another institution to contact the student-athlete about transferring to that institution, the student-athlete has the right to request an appeal. Student-athletes also have the right to appeal the University's decision to deny them the right to use the One Time Transfer Exception under NCAA Bylaw 14.5.5.2.10.
The following is the list of procedures associated with both appeals processes:
- To initiate the appeal, a written request must be submitted to my office within 10 working days from receipt of this letter. The letter must describe the reasons you believe the denial should be overturned. Failure to submit the letter within the prescribed deadline will be considered a waiver of your right to an appeal.
- Once a copy of your letter is received (submitted prior to the deadline), the Faculty Athletics Representative (FAR) will notify the Transfer Release Appeals Committee of your request and arrange the time and place for a hearing.
- Prior to the hearing, both the student-athlete and the head coach will submit written statements and any additional supporting documents detailing the rationale for their decision or request to my office. This information will be provided to the committee members prior to the hearing for their review.
- The presence of the student-athlete and the head coach at the hearing is mandatory. Parents or legal guardians of the student-athlete may be present to observe the hearing and respond to questions or invitations directed to them by the members of the TRAC committee. An attorney for either party may be present at the hearing; however their participation will be limited to advising their party. Under no circumstances will the attorney be permitted to present the case for either party.
- The Chair will open the hearing with introductions and a summary of the procedures for the hearing. The hearing is an administrative hearing; therefore, the formal rules of evidence do not apply. The student athlete will present his or her reason for requesting the appeal. The head coach will follow with the rationale for the denial. Following the two presentations, the Chair of the committee will moderate a question and answer period to clarify any unclear issues. Questions may be raised by members of the TRAC or the student-athlete and coach. Following the question and answer period, the student-athlete and head coach, in that order, will be given an opportunity to present a closing statement summarizing their respective positions.
- The TRAC will deliberate in private (with its legal counsel if participating) upon the information provided in the hearing, any existing precedent, and applicable NCAA, Big 12 Conference, and Oklahoma State University rules.
- The student-athlete will be notified of the decision orally in a reasonably expedient time following deliberations of the Committee and be given a written statement of the action taken by the TRAC within one week of the hearing.
- The decision of the TRAC is final.
